Enforcement of design rights becomes available for imported goods in Korea

Due to a revision of the Korean customs law patent rights and design rights can be enforced during custom procedures starting from July 2013. That means that in addition to the rights that can be enforced during custom procedures based on the current legislation (trademark rights, copyright, brand rights, geographic expressions) starting from July this year the scope of protection has been expanded to patent rights and design rights.

Therefore from July this year in order to control articles that infringe design or patent rights if required it will become possible to register design rights at the customs office beforehand.Intellectual property rights that can be enforced during custom procedures in China are trademarks, copyright, patent rights, utility model rights, and design rights.

In Japan persons that own patent rights, utility model rights, design rights, trademarks, copyright, neighboring rights or plant breeder rights, as well as persons that have the right to claim an injunction under the unfair competition law can send a request for prohibition of import to the chief customs inspector if goods that are about to be imported are found to be infringing their rights.
